Got the emails, I'm appalled but they apparently date back to August, had you done anything since ? As for a class action, seems premature at this point, anyway if you believe there is you should contact a lawyer, not vent about it here.
Again, does anyone have the exact licensing terms of the Freshmaps subscription ? Can't believe they would just drop the ball if there isn't any fine print that allows them to do it legally, even if it won't help their corporate image of course.
@dxace1 - Off-topic here but I can't remember about that problem on the european 8100s, many of them would have been updated to the 8300 software too, either for pay or for free depending on when they were bought. |

| Maybe we should ask Navigon for a copy of their FreshMaps terms. That might get their attention better than anything else! |

All I can say to that is good luck :) It is sad to say but I am at the point where I will just give up. I am not one to normally do that but there is just so much I want to try.
I guess I will have to purchase a new unit, now which one to choose that has similar features to the Navigon? |

I don't think there's a EULA available, at least I don't remember signing one. Not sure it would be enforceable anyway, but I'm not a lawyer.
I still have the box that my FreshMaps card came in. The small print on the back of the box says, in part "... Your FreshMaps subscription includes three years of complimentary map downloads. Up to 12 sequential map updates will be made available during the three year period. For FreshMaps accessory activation cards purchased, your (sic) must register your product at www.navigon.com/freshmaps within 60 days of the date of purchase of the accessory to qualify for updates..."
I suspect that our best hope for any kind of refund will come from the retailer. Accordingly, I recently sent this e-mail to the store from which I purchased the update card:
I'm a loyal Staples customer because you have great service, reliable merchandise and the best prices in town.
Over the past 2 years or so I've purchased the following electronic equipment at your store #64 (780 Tolmie Ave., Victoria BC): an Acer Aspire AST-180 Desktop computer and keyboard, a D-Link Dir 628 Router, an Acer Aspire one series ZG5 notebook, a Navigon 2120 Max navigation device, and a Navigon FreshMaps map and POI update card.
It's the last item on the list that's causing me some grief. I purchased the card for $49.97 plus tax on June 18, 2009. I still have the receipt. The FreshMaps card promises "regular map and POI updates" and "up to 12 map updates over 3 years."
The small print on the back of the box that the card came in says, in part, "... Your FreshMaps subscription includes three years of complimentary map downloads. Up to 12 sequential map updates will be made available during the three year period. For FreshMaps accessory activation cards purchased, your (sic) must register your product at www.navigon.com/freshmaps within 60 days of the date of purchase of the accessory to qualify for updates..."
I activated the card on the date of purchase and got the new version of the software and a map refresh for Q2 2009. Updates are promised every quarter (3 months). The Q3 update was scheduled for the end of July. As no update was available at that time, I've been checking the website every week or so since then and they still haven't provided a Q3 update.
When you contact Navigon customer support you get the following responses:

Software Upgrades, accessories, map material and content are not available in North America through NAVIGON.
As every company, NAVIGON Inc. has to adjust its business and strategy to meet the changing market conditions. These have changed from the time the decisions for launching the products were made so we had to restructure the business after we already announced the products.
NAVIGON Inc. will be reallocating resources from its branded line of portable navigation devices to focus on more profitable segments within the navigation sector in North America. This transition will place an increased emphasis on NAVIGON’s heritage, software development – the core of any navigation experience. NAVIGON Inc. will focus on software with an enthusiastic push into mobile and smartphone segments, as well as a continuation of support for both OEM and automotive sectors. NAVIGON Inc. believes that software development is our core competence.

As it appears likely that Navigon has abandoned its North American stand-alone GPS device customers in favour of the "mobile and smartphone segments" of the market, and because I have apparently been cheated out of 2 3/4 years of updates, is Staples prepared to offer me a refund?

| Thanks for sharing, yes I'm afraid the "Up to 12 sequential map updates" language gives them wiggle room, but there's no arguing that while not a commitment, associated to "three years of complimentary map downloads" the orignal intention was clear. Not a lawyer myself so I'm not sure if that could stand in court but it clearl looks bad. When ViaMichelin pulled out of the GPS business in France two years ago they refunded all of the €99 two year subscription program they had launched and took it upon themselves to contact the subscribers. The difference maybe is that you could only buy it from them, in the case of Navigon it was for sale in many places at wildly varying prices...which seemed odd at the time actually. |

Dear Mr. XXXXXXX, Thank you for your inquiry. The newest maps are presented quarterly, sometimes not exactly in that quarter, to whom they are named. It is not possible to say exactly when the new map will be available for download since we are still in the process of creating and checking the software. Sincerely p.p. Christian Josopait

| The back log, in my opinion, is caused by them developing for devices like the Iphone. Since our devices are no longer being sold in the US we are at the bottom of the list (I hope we are down at the bottom of the list and not off the list completly ) :) |

Here's the response I got form Staples:

Unfortunately as the product which you are referring to would be outside of the 30 days available for return or exchange you would need to discuss this issue with Navigon as Staples does not provide the updates as indicated in the product. The updates are provided by Navigon, and according to the navigon customer service information at the phone number 1-888-848-0701, customers with previously purchased versions would continue to receive updates, they will no longer be selling new updates, once the available stock of update cards has cleared out no further cards would be issued.

For those of us in the U.S. the company is now known as NaviGONE
I knew it was a matter of time before they abandonded us. A shame since the 7200T is a nice unit. |

They never said there would be an update every quarter. At least my Freshmaps did not say this. If they have two a year I would still be pleased. |

My Fresh Maps card said up to 12 updates over 3 years. That would equal one per quarter. I only received two updates.
I'm sure glad I got the Fresh Maps for $26.99 instead of full price.
Again, Navigon did not do the right thing for their U.S. customers.

| I believe navigon is making a nav product for the iPhone here in the US. If people knew what was going on with their stand alone units they might not purchase their iPhone product for fear of being stranded like us. |
